Notice of Terms of Proposed Real Estate Conveyance

TOWN OF MONKTON
NOTICE OF TERMS OF PROPOSED REAL ESTATE CONVEYANCE
PURSUANT TO 24 V.S.A. §1061(a)(1)

                The Town of Monkton hereby provides notice of the terms of a proposed granting of easements  and rights over, under, and through lands owned by the Town of Monkton to the Monkton Ridge Church Association pursuant to 24 V.S.A. §1061(a)(1).

Easement to be Granted:

An easement and right of way to install a replacement wastewater disposal system and necessary wastewater disposal lines and infrastructure to be located the lands and premises conveyed to the Town of Monkton by Warranty Deed of David K. Bean, dated  August 9, 2007 and recorded in Volume 115 at Page 477 of the Town of Monkton Land Records.

The location of the easement and right of way shall be mutually agreed to between the parties at the time Grantee is required to replace its existing wastewater disposal system.  The replacement disposal system shall be designed for a use and capacity similar to the Grantee’s current use and capacity. The easement shall include the location of the replacement wastewater disposal system and necessary wastewater lines running between the lands of Grantor and Grantee.

Said easement conveys to Grantee, its successors and assigns, the right to construct and maintain a replacement wastewater disposal system, together with the right to enter upon the property for construction, inspection, maintenance, repairs, and other such reasonable purposes as may arise regarding the wastewater disposal system.

The herein Grantor and Grantees, for themselves and their heirs, successors and assigns, covenant and agree that no structure, improvements, or development, other than the installation and maintenance of the said wastewater disposal system, shall take place upon any portion of the lands which are the subject of the easement herein described.

Immediately following any construction, replacement, restoration, maintenance or repair, which may take place on the easement area, the Grantees, their heirs, executors, administrators and assigns shall return the land within the easement area to as nearly to or better than its previous conditions as is practicable.

The easement shall run with the land and be binding upon the herein Grantor, its successors and assigns, and shall benefit the herein Grantees, their heirs, executors, administrators and assigns.

Notice is hereby provided, pursuant to 24 V.S.A. §1061(a)(2) that:

If a petition is signed by five percent of the legal voters of the municipality objection to the proposed conveyance is presented to the municipal clerk within 30 days of the date of posting and publication of the notice required by subdivision(1) of this subsection, the legislative body shall cause the question of whether the municipality shall convey the real estate to be considered at a special or annual meeting called for that purpose.   After the meeting, the real estate may be conveyed unless a majority of the voters of the municipality present and voting vote to disapprove of the conveyance.

Notice is also hereby provided that unless a petition is filed in accordance with 24 V.S.A. §1061(a)(2) as stated above, the Monkton Select Board will be authorized to proceed with granting the easement described above.
